1. Purpose of myNestBite

myNestBite is a platform exclusively designed to connect home-based food makers with consumers in their local communities. Our mission is to provide a platform where individuals who prepare food in their personal home kitchens can share their authentic, homemade dishes with neighbors and community members.

2. Seller Eligibility

By registering as a seller on myNestBite, you represent and warrant that:

• You are an individual home cook who prepares food in your personal residential kitchen.
• You are NOT a restaurant, commercial food establishment, ghost kitchen, catering company, food truck operator, or any other commercially licensed food business.
• You are NOT operating on behalf of, or as a front for, any commercial food business or franchise.
• Your food preparation takes place in a domestic residential setting, not in a commercial or industrial kitchen facility.
• You are the person who personally prepares or directly oversees the preparation of the food you list on the platform.
• You comply with all applicable local, state/provincial, and national cottage food laws, home food sale regulations, and food safety requirements in your jurisdiction.
• You hold any permits or licenses required by your local authorities for home-based food sales, where applicable.

3. Prohibited Sellers

The following entities and individuals are strictly prohibited from registering as sellers on myNestBite:

• Restaurants, cafes, bars, or any licensed commercial food establishments
• Ghost kitchens or cloud kitchens
• Catering companies
• Food trucks or mobile food vendors with commercial licenses
• Franchisees or agents of food chains
• Commercial food manufacturers or processors
• Resellers of commercially produced food items
• Any entity operating from a commercial or industrial kitchen space

4. Seller Declarations

Upon registration, every seller must acknowledge and agree to the following declarations:

1. Homemade Attestation: All food listed on my profile is prepared by me (or my household members) in my personal home kitchen using ingredients I have personally selected.
2. Non-Commercial Status: I do not operate a restaurant, commercial kitchen, or any commercially licensed food establishment.
3. Ingredient Transparency: I will accurately list the ingredients used in my food items and will not misrepresent the origin or nature of my ingredients.
4. Food Safety: I follow safe food handling practices and maintain cleanliness standards in my home kitchen.
5. Legal Compliance: I am aware of and comply with all local regulations governing the sale of homemade food in my area.

5. Seller Listing Requirement

Users who register as a Home Cook (seller) must create their food listing within 7 days of registration. A complete listing includes at minimum: business name, kitchen location, and at least one menu item.

If a seller account does not have an active food listing within 7 days:

• The account will be automatically suspended pending listing completion.
• The seller will receive a notification to complete their profile.
• Once a listing is created, the account will be automatically restored.
• Repeated registration without listing may result in permanent account restriction.

This policy exists to prevent abuse and ensure that seller registrations represent genuine home cooks who intend to share their food with the community.

6. Enforcement & Violations

myNestBite reserves the right to investigate any seller account suspected of violating these terms. If a seller is found to be operating a commercial food business or misrepresenting their status:

• Their account will be immediately suspended and may be permanently removed.
• All their listings and reviews will be removed from the platform.
• They may be permanently banned from creating new accounts.
• We may report violations to relevant local authorities if required by law.

Community members are encouraged to report any seller they believe is operating a commercial business through our reporting mechanism.

7. Consumer Responsibilities

As a consumer using myNestBite, you acknowledge that:

• Food purchased through this platform is prepared in home kitchens, not commercial facilities.
• Home kitchens may not be subject to the same health inspections as commercial restaurants.
• You are responsible for communicating any food allergies or dietary restrictions directly to the seller before purchasing.
• You assume personal responsibility for your decision to purchase and consume homemade food.
• myNestBite is a discovery platform only - transactions occur directly between buyer and seller.

8. Not a Selling or Ordering Platform

myNestBite is NOT a marketplace, e-commerce site, or food ordering platform. We do not facilitate sales, transactions, orders, deliveries, or any commercial exchange between parties.

myNestBite exists solely as a community discovery and advertising platform where:

• Home food makers can advertise and showcase their food, share their story, highlight their ingredients, and explain what makes their cooking special.
• Community members can discover home cooks in their area, learn about what they offer, and read reviews from others.

Any arrangement to purchase food happens entirely outside of myNestBite, directly between the parties involved.

Specifically, myNestBite:

• Does NOT process payments, accept orders, or facilitate any financial transactions.
• Does NOT act as an intermediary, broker, or agent between food makers and consumers.
• Does NOT provide shopping carts, checkout flows, or any ordering mechanism.
• Does NOT arrange, coordinate, or guarantee deliveries or pickups.
• Does NOT guarantee the quality, safety, availability, or legality of any food listed.
• Does NOT inspect or certify any home kitchen.
• Does NOT employ or contract with any food maker on the platform.

The platform is provided free of charge. Prices displayed on seller profiles are for informational purposes only and do not constitute an offer to sell.

9. Intellectual Property

Sellers retain ownership of their recipes, descriptions, and any content they post. By listing on myNestBite, sellers grant us a non-exclusive license to display their content on the platform for the purpose of connecting them with consumers.

10. Privacy

We collect only the information necessary to operate the platform (name, email, location, menu details). Seller addresses are used for proximity-based search and are displayed to consumers who search in the area. We do not sell personal data to third parties. See our Privacy Policy for full details.

11. Limitation of Liability

myNestBite and the platform shall not be held liable for any illness, injury, loss, or damage resulting from food purchased through sellers discovered on this platform. All food transactions are conducted directly between the seller and consumer at their own risk.

12. Changes to Terms

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. Sellers will be notified of material changes via email and may be required to re-accept updated terms.

14. Age Requirement

You must be at least 18 years of age to register on myNestBite. By creating an account, you confirm that you are 18 or older. We do not knowingly allow users under 18 to register.

15. Telephone Communications (TCPA)

Sellers who provide a phone number on their profile consent to receiving calls and text messages from registered users of myNestBite for the purpose of food enquiries related to their listings. This consent is limited to food-related communications only. Buyers agree that contact details are provided solely for food enquiries and must not be used for unsolicited marketing, spam, or harassment. Violation may result in immediate account suspension.

16. Disputes Between Users

myNestBite is a discovery and connection platform only. We are not a party to any transaction, arrangement, payment, or dispute between buyers and sellers. Any dispute — including but not limited to food quality, payment, delivery, or personal interactions — is solely between the buyer and seller involved.

myNestBite has no obligation to mediate, arbitrate, or resolve disputes between users. We encourage users to resolve disputes directly and amicably. If a seller or buyer engages in fraudulent, abusive, or illegal behaviour, you may report them via our platform reporting mechanism and we will review accordingly.

17. User Content & Intellectual Property

By uploading photos, descriptions, or any other content to myNestBite, you confirm that:

• You own or have the legal right to use all content you upload.
• Your content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
• You grant myNestBite a non-exclusive, royalty-free licence to display your content on the platform for the purpose of operating the service.

myNestBite reserves the right to remove any content that violates these terms or is otherwise deemed inappropriate.

18. Prohibited Conduct & Impersonation

Users must not:

• Create a profile impersonating another person, business, or entity.
• Provide false information about their identity, qualifications, or the nature of their food.
• Use another user's contact information for any purpose other than food-related enquiries.
• Harass, threaten, or abuse any other user of the platform.
• Attempt to circumvent, damage, or disrupt the platform or its infrastructure.

Violations may result in immediate account suspension and permanent ban. We reserve the right to report illegal conduct to relevant authorities.

19. Platform Availability & Service Changes

myNestBite is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or continuous availability of the platform. We reserve the right to:

• Suspend or discontinue the platform or any feature at any time, with or without notice.
• Modify, update, or remove any functionality of the platform.
• Delete inactive accounts or listings that have not been updated for an extended period.

myNestBite shall not be liable for any loss or inconvenience resulting from platform downtime, data loss, or service discontinuation.

20. Indemnification

You agree to indemnify, defend, and hold harmless myNestBite and the platform from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your use of or access to the platform.
• Your violation of these Terms & Conditions.
• Your violation of any applicable law or regulation, including cottage food laws.
• Any content you post, upload, or transmit through the platform.
• Any transaction, dispute, injury, or harm arising from your interactions with other users.
• Any misrepresentation of your status as a home cook or the nature of your food.

21. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from or relating to these terms or your use of myNestBite shall be subject to the exclusive jurisdiction of the courts located in Delaware, USA.

If you are accessing myNestBite from outside the United States, you are responsible for compliance with your local laws. Nothing in these terms limits your rights under applicable consumer protection laws in your jurisdiction.

17. Personal Safety During Meetups

myNestBite facilitates discovery and connection between home cooks and food lovers. Any physical meetup — including but not limited to food pickup, home delivery, or in-person transactions — is arranged entirely between the parties involved and is outside the control of myNestBite.

myNestBite expressly disclaims all liability for any personal injury, harm, loss, damage, or incident of any kind that occurs during or in connection with a physical meetup, pickup, or delivery arranged through connections made on this platform. This includes but is not limited to:

• Personal injury or harm to either party during pickup or delivery
• Theft, assault, or any criminal activity occurring during a meetup
• Property damage during delivery or pickup
• Any harm resulting from visiting a seller's home or premises
• Any harm caused by a buyer visiting a seller, or a seller visiting a buyer

Users are solely responsible for their own safety. We strongly recommend meeting in safe, public locations where possible, informing someone you trust of your plans, and exercising personal judgement before any in-person interaction. myNestBite does not conduct background checks on any user.
